1. What Gecko does
Gecko Checkout provides software that allows merchants to create and publish custom checkout experiences for Shopify stores, connect supported payment services including Whop, synchronize verified orders with Shopify, manage subscription information, view commerce analytics and use other features offered through Gecko.
Gecko is a software provider. Gecko is not a bank and does not itself take possession of shopper card funds processed through a merchant's connected payment account.
Shopper payments made through a merchant's Gecko checkout are processed through the merchant's connected Whop account and applicable payment infrastructure.
2. Accounts
- You must be at least 18 years old and use Gecko for business purposes.
- You must give accurate registration information and keep it up to date.
- If you act for a business, you confirm you have authority to bind it.
- You are responsible for keeping your password secure and for all activity under your account.
- Tell us promptly at support@geckocheckout.com if you believe your account has been compromised.
- You may not share accounts or create multiple accounts to get around plan limits.
3. Shopify, Whop and other third-party services
- Many Gecko features rely on Shopify, Whop and other third-party services.
- You are responsible for opening and maintaining those accounts and for complying with their rules.
- Gecko cannot guarantee that any third party will approve, keep open or continue to support your account.
- Gecko does not decide Whop (or any other provider's) holds, reserves, reviews or payout timing.
- Third-party APIs and features can change, and Gecko may need to modify or withdraw integrations as a result.
4. Gecko software billing
Gecko software billing is separate from the shopper payments your customers make at your checkout.
We intend to bill paid Gecko plans through Paddle, acting as our SaaS billing provider and Merchant of Record. Online purchase of paid plans is not yet available. Once it is, Paddle will process purchases of Gecko software plans, applicable taxes and billing documentation under its own terms and privacy notice, and we will update these Terms.
5. Plans and fees
- Gecko Build — $0. Build and test checkouts; no live payments.
- Gecko Basic — $49 per month, plus a 1% Gecko Checkout transaction fee on qualifying successfully verified payment volume processed through Gecko.
- Gecko Pro — $97 per month, with 0% Gecko Checkout transaction fees.
The Basic-plan Gecko transaction fee is calculated against qualifying successfully verified payment volume processed through Gecko, according to the billing records displayed by Gecko. Failed, declined, test/demo and otherwise unsuccessful payment attempts are not qualifying payment volume. The fee is a charge for Gecko's software; it is never added to your customers' payments.
- Fees charged by Whop, Shopify and other payment or third-party providers are separate and payable under their terms.
- Taxes may apply and may be collected by our billing provider where applicable.
- We may change prices for future billing periods with reasonable advance notice. Changes never apply retrospectively to fees already incurred.
6. Your responsibilities as a merchant
You are responsible for your business and your relationship with your customers, including:
- the products and services you sell and the claims you make about them
- pricing and the taxes you remain responsible for
- shipping, fulfilment, returns and refunds to your customers
- customer service and dispute evidence
- clear subscription and recurring-billing disclosures and consent
- marketing compliance, privacy notices and cookie/tracking consent on your checkouts
- compliance with consumer-protection law
7. Acceptable use
You must not use Gecko for:
- fraud, money laundering or unlawful payment activity
- illegal, counterfeit or infringing goods or services
- malware, abusive infrastructure use or unauthorised access, including attempts to access another merchant's data
- deceptive billing, hidden subscriptions or misleading recurring charges
- orders you do not intend to fulfil
- circumventing Shopify, Whop or other payment-provider restrictions
- misleading health or product claims
We may suspend accounts that pose a material legal, security, fraud, consumer-protection or payment-risk concern.
8. Subscriptions and recurring billing
- Gecko may provide tools for recurring billing through supported payment providers.
- You must clearly disclose the recurring amount and cadence and obtain lawful consent from your customers.
- The payment provider performs the actual recurring charge; successful renewal is not guaranteed.
- Gecko's subscription records do not mean Gecko stores raw card credentials. It does not.
9. Gecko AI
Gecko AI may generate checkout layouts, logos, draft copy, images, testimonial-style creative, design suggestions or other material based on information supplied by the merchant. AI-generated output may contain inaccuracies and must be reviewed before publication.
AI-generated testimonial text, synthetic customer names and UGC-style images are draft creative content and must not be represented as genuine verified customer endorsements unless the merchant has independently replaced or substantiated them with authentic customer material.
You are responsible for the legal review of AI output, substantiating claims, having rights to the images and assets you upload, and advertising and intellectual-property compliance. You must not use Gecko AI to impersonate real people, fabricate verified buyers, publish unsupported medical claims or present AI personas as genuine customers.
10. Your content
You keep ownership of the content you upload. You grant Gecko only the licence reasonably necessary to host, process, resize, transform, generate from, render, secure and otherwise provide the Service with that content. You confirm you have the rights to everything you upload.
11. Gecko's intellectual property
Gecko keeps all rights in its software, brand, interface, source code, design system and original technology. While your account is in good standing you have a limited, non-transferable right to use the Service.
12. Privacy and data processing
Our Privacy Policy explains how we handle personal data. Where Gecko processes shopper or customer personal data on your behalf, our Data Processing Addendum forms part of these Terms.
13. Service availability
We aim for reliable operation but cannot guarantee uninterrupted access, error-free software, the permanence of any third-party integration, or any specific conversion rate or revenue outcome. Figures, names and examples shown on our website may be illustrative or demonstration data.
14. Payment-provider decisions
Using Gecko does not guarantee that you will avoid payment holds, reserves, reviews, chargebacks, disputes, payout delays, or provider suspension or termination. Those decisions are made by the relevant providers under their own terms.
15. Suspension and termination
- You may stop using Gecko at any time and cancel a paid plan as described in our Refund & Cancellation Policy.
- We may suspend or end access for breach, non-payment, security, fraud or legal risk.
- Fees already accrued remain payable after termination.
- We may keep certain records where required for legal, tax or security purposes.
16. Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available". Nothing in these Terms excludes rights that cannot lawfully be excluded.
17. Limitation of liability
To the fullest extent permitted by law, Gecko will not be liable for indirect, incidental, special or consequential losses, including loss of profit, revenue, goodwill, opportunity or anticipated savings.
Subject to liabilities that cannot legally be excluded or limited, Gecko's aggregate liability arising from the Service will not exceed the fees paid to Gecko during the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.
18. Indemnity
To the extent permitted by law, you will indemnify Gecko against third-party claims arising from your products, your unlawful conduct, your breach of these Terms, your infringement of others' rights, misleading communications to your customers, or your failure to meet your legal obligations.
19. Changes to these Terms
We may update these Terms. For material changes we will update the date above and give reasonable notice where appropriate.
20. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory law that applies to you.
